This document states the terms and conditions that customers receiving utility services from Her Utility Ltd must adhere to. Below are the terms that go into effect once a business contracts to receive our switching service.

The terms and conditions set forth govern the use of our utility services, you should carefully read them before you sign up with Her Utility. By using our services it means that you have read this document, understand our terms and conditions, and agree to be governed by them. If you disagree with these terms, we respectfully ask you not to sign up for our switching service.

Switching Service

We provide UK businesses with a switching service based on our price comparison efforts. To qualify for this service, customers must:

  1. Own a business located in the UK.
  2. Be at least 18 years of age (if the sole owner of the business).
  3. Have a credit score that meets any supplier’s requirements. We have the right to refuse services to any business at our sole discretion.

If a customer signs up for our services, we will make every effort to determine, negotiate and pin down competitive energy prices, which can be obtained from the price books of our panel of suppliers. Our customer must provide us with correct information, so that we can get accurate quotations. The information we need are the customer’s actual energy usage or a close estimate, end dates of current contracts, and other factors that could impact the quotations and prices.

A supplier’s quotation to Her Utility is not a confirmed offer to our customer in that each offer will come with that supplier’s own set of terms and requirements.

If the quotation is accepted by our customer and a contract is drawn up and signed by the customer and supplier, it is a binding contract. The customer is not allowed to revoke their acceptance. Also, the supplier reserves the right at their discretion to decide not to accept the customer’s offer to accept the quotation.

If our customer and the supplier decide to enter into an energy contract, we will provide the switching (or renewal) service. This will include arranging the contract between both parties for purchasing the energy that will be supplied to our customer.

Her Utility cannot be held liable for any failures or delays caused by our customer, the prospective supplier, or the current supplier related to either transferring or renewing the energy supply.

Her Utility cannot guarantee the quality of services that the suppliers provide, or the prices being quoted. Energy prices go up and down on a daily basis and although we try to secure competitive pricing to effectuate switching or the renewal, we have no way to guarantee that any price quote is actually the lowest.

The customer must be cognisant of the fact that it is up to them to verify the accuracy of the quote being presented.

The customer recognises that they are contracting directly with the supplier for energy and not with Her Utility. Furthermore, our customer understands that we are not liable for any contracts, transactions, payments owed, or other dealings between the customer and the energy supplier. The customer agrees to accept the risk and the responsibility.

The customer agrees that Her Utility is a fully independent company working as an energy broker and that we are not acting as their exclusive agent or representative. Also, the customer recognizes that Her Utility is not responsible for the stipulations of the supplier.

Remuneration

Her Utility is directly paid by the energy supplier in the form of a commission for effectuating the contract between our customer and them. This usually takes the form of an uplift, which is applied to their unit cost of the energy.

Our uplifts are determined by the size of the contract, length of service, credit risk, and other factors. An average uplift would be several percent of the total cost of energy, which is usually less than 1p.

Therefore, the cost of our services is included in the price of the contract you enter into with the supplier.

Because the energy suppliers are the ones paying us, we only discuss the prices offered by our panel of suppliers, which currently consists of more than 90% of the energy suppliers that supply businesses located in the UK. This means that we work with a very broad range of energy suppliers that we get our quotations from.

Failed Contract Fees

When a customer usesHer Utility to effectuate a contract with an energy supplier, the resulting contract is legally binding. Should that customer sign a contract with some other energy supplier, causing the contract negotiated by Her Utility not to proceed, the supplier will not pay Her Utility for our services, which causes us to suffer losses.

In that situation, Her Utility has the right to invoice that customer a one-time “failed contract” fee amounting to £500 per meter. This would be added to any charges that the supplier may try to recover from us for the contract that failed to proceed. Once you have a signed contract with an energy supplier it is important that you honour it and avoid entering into duplicate contracts.
